Jerry Koch speaks on behalf of Luke O’Donovan

This week we spoke with Jerry Koch, an anarchist who was coercively imprisoned for refusing to cooperate with a federal grand jury in New York City, about Luke O’Donovan’s legal case.

From Luke’s support website:

“On New Year’s Eve of 2013, Luke O’Donovan attended a house party in Reynoldstown, a neighborhood in Atlanta, Georgia. Luke was seen dancing with and kissing other men at the party. Later in the night he was insulted with homophobic slurs, and attacked by several people at once. Luke unsuccessfully attempted to escape, at which point several witnesses reported watching between 5 and 12 men ganging-up on Luke and stomping on his head and body, evidently with the intent to kill him. Luke was called a faggot before and during the attack. Throughout the course of the attack, Luke and five others were stabbed. Luke was subsequently imprisoned and charged with five counts of aggravated assault with a deadly weapon as well as one count of attempted murder. He spent two and a half weeks in jail without bond before being released under bond conditions that drastically affected his life. None of the other individuals involved in the altercation were charged.”

On August 12th of this year, Luke O’Donovan took a plea deal, which reduced his sentence of up to 110 years in prison to 2 years in prison with 8 years of probation alongside criminal banishment. Luke’s supporters – as well as The Final Straw participants – believe that the choice to plead guilty was coercively enacted by the court systems and the state and Luke is thoroughly supported in having to have made that choice.

We speak with Jerry Koch about the particulars of this case, what anarchist interaction with the court system can look like, as well as of his own case and his thoughts thereupon. We also speak about supporting folks who are incarcerated and the various forms that support could take, as well as things that folks doing support might consider.

This week William speaks with V, who is an anarchist living in Bloomington IN about current and former instances of racist and institutional violence against inmates at the Pendleton Correctional Institution in Madison County, Indiana. Folks are organizing a call in day from 11am-1pm EST on Monday, September 8th. Adam talks about the last-minute announcement of a change of the beginning of Luke’s trial to Tuesday, August 12th and gives a brief synopsis of the case. Following that, you’ll hear a conversation with a supporter of the 5E3 and friend of Amélie Trudeau and Fallon Rouiller, the two Quebecois anarchists who, along with Carlos López Marin, make up the 5E3. The 5E3 are 3 anarchists arrested on the 5th of January and accused of taking part in a molotov cocktail attack on the Ministry of Communication and Transportation and a neighboring Nissan Dealership in Mexico City. We’ll talk about the mexican prison system, the political context within which insurrectional anarchism in mexico is traversing, about Prisoners’ Justice Day in Canada and abroad and much more. We’ll also touch briefly on the case of Nyki Kish, an anarchist convicted of stabbing and killing a college student while among a group of college students who were attacking homeless folks in Toronto. Our first segment (after Sean’s words of wisdom) is a conversation with D, an anarchist and prison abolitionist from West Virginia to update us about the Elk River chemical spill from January of this year. We talk about the West Virginia Clean Water Hub and the project it recently spawned, Voices From South Central WV. Voices from South Central is working to amplify the voices of prisoners at the main jail in Charleston, WV. The project began as a way of gauging and presenting (in prisoners own words) the effects of the water crisis on those incarcerated and how the administration dealt with health effects it caused and worked (or didn’t) to provide clean water to those they jailed.

No-TAV resistance and metal

This week’s episode features a short interview with a member of the No-TAV struggle in the Italian Alps. For decades the residents of Val di Susa in northern Italy (near Turin) have been struggling to stop the development of a 30 mile long tunnel through the mountains, across the border to Lyon, France. The project is a European Union one that is one wing of a larger international commercial venture web of restricted transit for goods that EU is attempting to push through. The actual tunneling threatens, among other things, to release enough uranium and asbestos into the air and shallow water-table of Val di Susa and surrounding areas that even the EU estimates that the damage will be measurable and irreparable.

We speak about what shapes the resistance has taken, how anarchists and others have engaged at varying times, and the repression faced from the government. Currently, there are arrests and incarcerations and investigations concerning, among other activities, a night-time raid in 2012 of the militarized construction site of the TAV which was arsoned and effectively shut down for a period of time afterwards. Some of the vocal anarchist and activist arrestees are facing terrorism charges based on Italy’s EU-adopted laws concerning resistance to government projects. The new definition basically posits that those who effectively make it so the government can’t do something (good or bad) and the EU wants it to happen, the national government is pressed to prosecute. This week’s episode features a couple of announcements about the upcoming June 11th Day of Solidarity with Marius Mason, Eric McDavid and Longterm Anarchist and Eco Prisoners. At 9pm on June 11th, there’ll be a show at the Odditorium. The benefit requests a $5-20 donation. Ben Turk on the silencing of Sean Swain, anarchist prisoner in Ohio

On April 6th of 2014, anarchist prisoner Sean Swain, who’s been kind enough to allow us to present his audio commentaries (available at http://www.seanswain.org) had his access to phone calls and email shut down by JPay corporation (which facilitates financial transactions between prisoners and their families and other corporations while skimming profit and also saving and mining the private user data) alongside of Global Tel* Link. This comes just after Sean was able to engage a new lawyer, Richard Kerger, who’s done work on the Lucasville Uprising death row prisoners.

This episode, we speak to Ben Turk, a supporter of Sean’s about new updates in Sean’s case, his silencing and how folks can help pressure the state to give Sean back his access to phones and email.

Prior to that interview, however, a special guest reads a script from Sean for this week’s “You Are The Resistance”. Take a listen, or find it later at archive.org as youaretheresistance04132014 alongside the past segments for download or streaming.

Ben then tells us about his efforts, via Insurgent Theatre, to print a compendium of the plays he’s written and his upcoming tour of the play BADGE (formerly known Know Your Enemies and prior to that as ACAB), where Ben play’s the part of Officer Friendly, a community liaison officer who slowly realizes that, in fact, all cops are bastards. This play will be touring with D. Jones’ film “The Shadow of Lucasville” around numerous parts of the U.S. and Canada.
